Intra-Company Transferees Executive​ or Manager

The L-1A nonimmigrant classification enables a U.S. employer to transfer an executive or manager from one of its affiliated foreign offices to one of its offices in the United States.  This classification also enables a foreign company which does not yet have an affiliated U.S. office to send an executive or manager to the United States with the purpose of establishing one. 

To qualify for L-1 classification in this category, the employer must:

  • Have a qualifying relationship with a foreign company (parent company, branch, subsidiary, or affiliate, collectively referred to as qualifying organizations); and
  • Currently be, or will be, doing business as an employer in the United States and in at least one other country directly or through a qualifying organization for the duration of the beneficiary’s stay in the United States as an L-1.  While the business must be viable, there is no requirement that it be engaged in international trade.

To qualify, the named employee must also:

  • Generally have been working for a qualifying organization abroad for one continuous year within the three years immediately preceding his or her admission to the United States; and
  • Be seeking to enter the United States to provide service in an executive or managerial capacity for a branch of the same employer or one of its qualifying organizations.

Sending an employee to the United States as an executive or manager to establish a new office:

  • The employer has secured sufficient physical premises to house the new office;
  • The employee has been employed as an executive or manager for one continuous year in the three years preceding the filing of the petition; and
  • The intended U.S. office will support an executive or managerial position within one year of the approval of the petition.

Qualified employees entering the United States to establish a new office will be allowed a maximum initial stay of one year.  All other qualified employees will be allowed a maximum initial stay of three years.  For all L-1A employees, requests for extension of stay may be granted in increments of up to an additional two years, until the employee has reached the maximum limit of seven years.


The transferring employee may be accompanied or followed by his or her spouse and unmarried children who are under 21 years of age.  Such family members may seek admission in L-2 nonimmigrant classification and, if approved, generally will be granted the same period of stay as the employee.  

L-1A 跨国经理签证

高级管理人员/行政主管

L-1签证是非移民的工作签证,允许中国公司调配员工进入美国的分公司,子公司或附属公司任职。适用于在中国(或其它国家)拥有企业的企业主或高管,在美国拓展业务,以工作签证先快速进入美国,配偶可以工作,孩子也可快速进入美国公立学校读书。进而根据需求,申请转为绿卡。 


L-1签证分为两个类型:L-1A 高级管理人员或行政主管和L-1B特殊技能人员
L-1A签证有效期最多可以高达7年,包括第一次申请有效期3年和两次延期各2年;L-1B签证有效期最多可以高达5年,包括第一次申请有效期3年和一次延期2年。当L-1签证的最长效期到期以后,L-1签证的持有者需离开美国至少一年后,才可以重新申请新的L-1签证。 L-1签证允许有意向在美国设立分公司或者办公室,需要将高级管理人员和特殊技能人员派到美国来进行筹备新公司,但是新成立的美国分公司首次申请L-1签证有效期只有一年,一年后必须提出延期的申请。


L-1A 签证高层管理人员或行政主管 ,可以通过EB-1C跨国公司的主管或经理申请绿卡身份。 EB-1C不受排期的影响,所以受益人不需要长时间的等待签证名额,可以同时递交I-140和I-485美国境内调整身份。


L-1签证的优势

    如申请人已申请移民,将不会影响L-1签证的申请。如果已申请EB-5投资移民,但由于排期漫长,如果为了孩子读书而需提前来美,大人除了可以申请F-1,H-1B之外,也可以申请L-1,以保持在美国合法身份。 
  3. 投资金额少
    没有特定的投资金额和区域要求,初始的投资金额可以很低(如10万美元),也没有个人外汇管制的问题 
  4. 短时间内入境
    半年内即可审批结束入境,快的3-4个月即可入境 v 掌控公司的日常营运 签证持有人直接管理公司的日常运作
  5. 公司规模无需很大
    公司规模并不要求是特大企业,基本上只要申请的公司可以证明美国公司的规模和发展需要一名高级管理人员即可

L-1A签证的申请条件 

  1. 中国公司在提交申请前的3年内,签证受益人需要连续一年在该公司工作; 
  2. 签证受益人在美国境内(分公司,子公司或附属公司)必须任职高层管理人员或者行政主管等职位; 
  3. 高层管理人员职责是主要管理一个公司或部门的日常运作,对其管理的员工有任命和罢免的权力; 
  4. 申请人的工作经验以及在中国公司担任的职位和职务需要与将在美国担任的职位相符 


L-1 签证申请的流程
首先需要委托一位专业的移民律师,如果是有意向在美国设立新的分公司或者办公室的话,接下来需要注册申请新的公司,如果是现有的分公司,这一步可以省略。在有了注册的分公司以后,需要制定符合L-1签证申请所要求的商业计划书(律师会协助撰写)。在申请人向律师递交相关的材料和所需文件后,律师会向移民局提交申请。L-1签证的审批时间通常需要3-4个月,如果申请人选择加急处理,一般在15天内就可以知道结果。
